I chatted with a guy a couple of times before, and I seen him today by my bus stop. He lives in the flat above my local newsagents and the owner of the newsagents (who I always thought was nice) was putting his debts into the guys name and taking his mail (as he lives above the shop, his mail goes into the shop). As a result of debts that had nothing to do with him, he nearly got evicted. The owner is being taken to court, what could the punishment be for fraud (I know prison, but is prison a guarantee) ? This is in the UK by the way.

Depends on the sum. It would have to be many thousands to warrant a prison sentence in the U.K.
Your first FATAL error writing this FICTION is that claim he almost got evicted due to the false debts.
If the person LEGALLY rented a residence over the news stand, he had a SEPARATE mailing address. If not, the person ILLEGALLY renting the residence WOULD NOT evict him over the debts THEY took out in his name, because that would expose BOTH of the crimes you claim they committed.
The only REAL question here is if you fell for FLAT OUT LIES by the guy this allegedly happened to, or it you are a bad fiction writer.
No.. But they usually eventually are held accountable and do time
