A San Francisco police gang expert testified Wednesday that the man accused of murdering a father and his two sons told investigators that the leader of a gang faction had mistaken the young men for rivals and opened fire.Sgt. Mario Molina testified in the preliminary hearing in San Francisco Superior Court for Edwin Ramos, 22, who is charged with three counts of murder in the June 22, 2008, shootings in the Excelsior district that killed Tony Bologna, 48, and his sons Michael, 20, and Matthew, 16.

His attorneys have denied Ramos is a gang member and insisted he did not pull the trigger. Ramos told police that another man, described by investigators as the leader of a faction of the MS-13 gang, fired the fatal shots from a car Ramos was driving, Molina testified.

Molina, who has specialized in Latino gangs for more than a decade, most recently with the police gang task force, testified that he has long known Ramos. He said Ramos told him in 2005 that he had joined the MS-13 gang, a subset of the statewide Sureños, when he was 12 years old.

Guy MS 13 is mostly illegal here illegally how about the Federal officials also confirmed that two other suspects in the Denny's shooting are here illegally, but it is unclear whether 22-year-old Marvin Lopez-Aguilar and 25-year-old Francisco Melgar had previously been deported to El Salvador.

Ortiz and Lopez-Aguilar remained jailed at the MDC late Tuesday on no-bond holds.

They are charged with murder in the killing of Denny's cook Stephanie Anderson and more than 40 other felony counts.

Authorities were still searching for Melgar, who faces the same charges.

Police say Melgar and Ortiz are MS-13 gang members.
