Hello. I am currently working at a diesel shop where I am a supervisor. I just switched to a new location that doesn’t have pits . So you work from laying on your back. They always allow the drivers to sit in their semi trucks while they are being worked on. Yesterday I was laying under a truck working on its oil pan and the driver began to turn over the engine WHILE I WAS LAYING UNDER THE AXLE and while his engine had no oil. Is the breaking any violations ? I always tell them I feel un safe allowing people like that in their trucks with my life in their hands and they always put it as no ones got hurt fro anything like that in the past 20 years so why would it happen now . What should I do about this. I feel as if I could tell the drivers to get out and can watch from a distanc or sit in the lobby or what ever but I doubt any one else will get on board with this idea. Some one please tell me this is violation something . I don’t want to involve osha or any of that I rather just go about it by telling them there breaking a code or law or what ever and that I will not allow it on what I am working on . No law prevents it, but it is (for reasons such as you describe) incredibly dangerous and stupid to do so.
It isn't laws so much as liability.
The insurance companies covering the shops commonly specifically exclude any injuries to customers in such cases. They just won't accept the financial risk.
No, and for a number of reasons it is good policy to not allow anyone but employees in the shop area.
No idea what the rules are wherever you are, but here it is not permitted for a customer to be in the workshop unless escorted by a member of staff. It's a Health & Safety matter (and probably required under the insurance too). You'd better find out what the rules are where you are.
No, but there are sometimes insurance rules that disallow customers to be in work areas. It is up to you to remove them, not the customers responsibility to know your rules.
