You did not supply enough information. Who is at fault would depend on a number of factors. Including but not limited to the age of the child, was the driver following all the driving laws, the reason that the accident happened etc.
If the child is too young or too immature to know road safety, parents are partially responsible and would fave neglect/endangerment charges.
Driver is at fault as well. As a driver, you are suppossed to be aware of your surroundings and for potential hazards- which includes watching for pedestrians
It depends what country you are in. Logically it is not the fault of the driver if he is obeying the rules of the road and the child is not. A young child should be supervised, so the parents might be at fault.
In north america, people do not take responsibility for their own actions, and always blame someone else, so pedestrians wander all over the road like cattle.
In other parts of the world, children learn road sense and they stay out of the way of cars.
Depends...trying to blanket cover all possibilities is silly. Come to Germany where I now live, most kids from age five on go to school through the city by themselves.
And child is vague. From the time I was six, all the other kids and I road a schoolbus and then walked a long way home along the road.
