23. False. Levels of involvement of co-conspirators can be different, one may have a minor role and one could have a major role.
41. Yes. It would not be enough that the defendant fortuitously committed an act (even a criminal act) the resulted in the underlying crime. The defendant needs to have intended that the underlying crime be committed.
