Most of that radiant energy (heat) stays lower to the ground, so it's maybe -1 degrees in the sky when it's 1 down by humans. Usually it will rain if it's above 2 degrees, because the temperature higher in the sky is still slightly above freezing. And yes, it DEFINITELY has to be 0 degrees or lower, at least in the clouds, to produce the chemical reactions necessary to change water's state of matter.

I believe snow forms when the temperature is cold enough. Remember, it is much colder a mile up in the sky then here on the surface of the planet. That is why I have seen snow falling when it is 50 degrees Fahrenheit. Of course the snow can't stay for long at those temperatures but it can still be snowing.
